Another Win for The First Amendment

A Rhode Island Tesla owner requested FKGAS as his vanity plate. The Rhode Island DMV refused to issue it, claiming it was obscene.

Challenging the denial as arbitrary and capricious, and showing the DMV had no actual criteria other than complaints from those denied, he went to Federal court.

The judge found that the DMV did, indeed, have no criteria, both approved and denied the same plate requests, and issued others that were arguably offensive. 

In a well-researched and reasoned decision, the court DENIED the DMV's Motion to Dismiss and GRANTED the Plaintiff's Injunction. He will get his FKGAS plate.
